Adopting a publication scheme is a requirement of the Freedom of Information Act 2000. The Act promotes greater openness and accountability across the public sector by requiring all 'public authorities' to make information available proactively through a publication scheme. Dearne Valley College is a Public Authority as defined in the Act.
What is a publication scheme?
A publication scheme describes the information a public authority publishes, or intends to publish. It sets out the classes, or categories, of information published. It states how the information described can be accessed and whether or not charges will be made.
Dearne Valley College has adopted the model publication scheme developed for the further education sector and is committed to publishing the information it describes.
• Information that can reasonably described as commercially sensitive, need not be disclosed under FOI legislation.
• Information subject to the Data Protection Act cannot be disclosed by the college, even if the FOI Act is invoked. This includes information such as personal or private data such as achievement records for a particular learner or salary information relating to a particular member of staff.
• Policies and procedures undergo regular review and every effort is made to ensure published documents are current but processes may change before the scheduled review date – please check with the Quality Officer on 01709 513333 extension 1112.

Written requests for information covered by the publication scheme
The classes of information we publish are listed on our Full Publication Scheme. We have indicated how the information will be made available. Information which is available to download from our website is provided free of charge. Charges may be made for other information and confirmation of the charge will be given before the information is provided. Payment may be requested prior to provision of the information.

Your request will be acknowledged within 20 days and, where the request complies with the Act and any charge has been paid, the information will be provided as soon as practicably possible.
We are not required to release information to which an exemption in the Act legitimately applies. However, we will explain to the applicant why we are not releasing information and we will justify this to the Information Commissioner.
If we are unable to supply the information requested, or you are dissatisfied with our response, or feel that a fee has been applied unfairly you may ask for a review of that decision via the appeals procedure.

We also welcome suggestions as to how our scheme might be improved. Any questions, comments or complaints about this scheme should be sent in writing to the Publication Scheme Co-ordinator (as above).
If you are not satisfied with the college’s handling of your complaint, you can write to the Information Commissioner, the independent body who oversees the Freedom of Information Act.
